Terms of Service

These Terms of Service (“Terms”) govern your access to and use of FocusIntel (“FocusIntel,” a CyberIQ Experience, “we,” “us,” or “our”), the compliance-evidence platform operated by CyberIQ at cmmc.cyberiq.com (the “Service”). By accessing or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization, and “you” refers to that organization.
The Service
FocusIntel helps organizations assess and demonstrate their CMMC and NIST SP 800-171 posture by collecting evidence from sources you connect (such as Google Workspace and Microsoft 365), mapping it to controls, and generating reports. We may update, improve, or change features of the Service over time.
Accounts and eligibility
You must sign in through a supported identity provider and keep your account credentials secure. You are responsible for activity under your account and for your users’ compliance with these Terms. The Service is intended for organizational and business use, not for consumers.
Connected sources and authorization
When you connect a source, you authorize FocusIntel to access and process the audit-log and security-configuration data described in our Privacy Policy. You represent that you have the authority and any necessary consents to connect that source and to allow this processing. You may disconnect a source at any time, which stops further collection from it.
Acceptable use
You agree not to:
- use the Service in violation of any law or third-party right;
- access data or accounts you are not authorized to access, or connect a source without authorization;
- interfere with, disrupt, probe, or attempt to gain unauthorized access to the Service or its infrastructure;
- reverse engineer, resell, or use the Service to build a competing product, except as permitted by law.
Customer data
As between you and us, you retain all rights to the data you connect and the evidence we collect on your behalf (“Customer Data”). You grant us a limited right to process Customer Data solely to provide, secure, and improve the Service as described in the Privacy Policy. We do not sell Customer Data or use data from connected sources for advertising.
Intellectual property
The Service, including its software, content, and trademarks, is owned by CyberIQ and its licensors and is protected by intellectual-property laws. Except for the rights expressly granted here, we reserve all rights in the Service. Reports and documents the Service generates from your Customer Data are yours to use.
Third-party services
The Service integrates with third-party platforms (for example, Google, Microsoft, and Amazon Web Services). Your use of those platforms is governed by their own terms, and we are not responsible for them. Our use of information from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
Compliance disclaimer
FocusIntel is a tool that helps you organize and assess compliance evidence. It does not provide legal advice and does not guarantee that you will achieve or maintain any certification or regulatory outcome, including CMMC certification. You remain responsible for your own compliance obligations and for verifying the accuracy and completeness of the evidence and reports the Service produces.
Disclaimers and limitation of liability
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. To the maximum extent permitted by law, neither CyberIQ nor its suppliers will be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising out of or relating to your use of the Service.
Term and termination
These Terms apply while you use the Service. You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or its users. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
Governing law and venue
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws principles. You and CyberIQ agree that the exclusive jurisdiction and venue for any dispute arising out of or relating to these Terms or the Service will be the state and federal courts located in Maryland, and each party consents to the personal jurisdiction of those courts.
